Terms and Conditions of Monglish Academy Limited

These terms and conditions apply to the services provided by Monglish Academy Ltd., 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. Company Registration Number: 14083316 (“Monglish Academy Ltd.”, “we”, “our” or “us”). These terms and conditions govern the sale of online courses through the website https://monglish.co.uk. Please read these terms and conditions carefully before purchasing any online course.

Website Disclaimer

By purchasing through our website and ticking the box indicating “I have read and agree to the website terms and conditions”, you agree to be bound by the terms of this agreement. If you do not agree to these terms and conditions, you must discontinue the purchase process

1) Definitions

  • “Confidential Information” means any information disclosed by either party to the other in written, graphic, recorded, machine-readable or other form concerning the business, clients, suppliers, finances or other affairs of the other party, including but not limited to course materials. It excludes information that is public (other than through breach), required to be disclosed by law, or already in the receiving party’s possession.

  • “Course Materials” means any content provided by Monglish Academy Ltd. in electronic format to support a course delivered as part of the services.

  • “Fees” means the charges paid by you to Monglish Academy Ltd. for the services.

  • “Intellectual Property Rights” includes copyrights, database rights, patents, design rights, trademarks, trade secrets, and all other intellectual property rights (registered or unregistered) globally.

  • “Online Course” means a course delivered remotely via the internet where course materials are studied independently.

  • “Services” refers to the provision of online courses and associated course materials, along with any additional services purchased through the website, by phone, WhatsApp, or social media.

  • “Website” means https://monglish.co.uk/

  • “You” means the individual or organisation purchasing the services.

2) Services

Service descriptions and start dates are available on our website. We will deliver the services with reasonable care and skill, as described on the website. We reserve the right to amend or withdraw any services from the website without notice. It is your responsibility to ensure that the services meet your needs. We do not guarantee specific results, qualifications, or employment opportunities from any course.


3) Ordering and Delivery

To enrol in a course, you must create an account on our website. If you already have an account, log in using your username and password. You may also purchase services through direct contact via phone, WhatsApp, or social media. Payment is made through a secure direct payment link. By submitting an order on the website, you are offering to purchase services under these terms. Monglish Academy Ltd. reserves the right to reject or cancel any order at any time until confirmed as stated in 3.5 below. Upon receiving your order, we will contact you via email, phone, or WhatsApp to confirm the order and provide access to Zoom lessons and Class DOJO. Delivery is 100% online. Access begins within 24–48 hours of payment confirmation unless a deferred start was selected. A legally binding agreement is formed once we confirm your order and receive full payment as per Clause 5. If your order includes multiple courses, each course will be treated as a separate contract.


4) Cancellation and Refund Policy

Subject to Clause 4.2, once your order is confirmed as per Clause 3.5, you may cancel the purchase in line with our published cancellation and deferral policies accessible [here]. If you have accessed any portion of the online course or begun using it, you lose your right to cancel. No further cancellations or changes are allowed unless approved at Monglish Academy Ltd.’s sole discretion.

5) Fees

Course fees are as displayed on the website or communicated by phone at the time of ordering. Payments are made via Stripe UK using debit/credit cards. Fees must be paid in full before course access is granted. You are responsible for any costs incurred in connection with your participation in an online course.


6) Liability

Our services do not constitute investment or professional advice. While we aim to deliver services at a high standard, Monglish Academy Ltd. and its authors are not liable for:
(a) inaccurate or misleading information in course materials or reliance on them,
(b) data loss,
(c) loss of profits, revenue, or reputation,
(d) indirect or consequential losses from a breach of these terms.
Except as explicitly stated, we give no warranties or guarantees (express or implied). Our total liability is limited to the fees paid for the relevant course giving rise to the claim. Nothing in these terms limits liability for death, personal injury, fraud, or any other liability that cannot be excluded under English law. No claims may be brought more than six months after the date of service delivery or discontinuation.


7) Intellectual Property

All intellectual property in the course content and materials remains the sole property of Monglish Academy Ltd., regardless of customisation. You may not:
(a) reproduce, resell, republish, or transmit any course material,
(b) record the course,
(c) use materials to deliver your own course,
(d) remove copyright notices,
(e) reverse engineer any course software.
Breach of this clause may result in immediate termination of access. You are granted a limited, non-transferable, non-exclusive licence to use the course materials solely to complete the course during your access period.


8) Confidentiality

Each party must keep the other’s confidential information secure and use it only for the purposes of this agreement. Information may be disclosed to legal or professional advisers. This clause survives termination of the agreement.


9) Termination of the contract

  • fail to pay fees when due, or
  • breach any term of this agreement. Clauses 6 (Liability), 7 (IP), 8 (Confidentiality), and 10 (Restrictions) will remain in effect after termination.


10) Non-Transferability

Services provided are personal to you and may not be transferred to others. We may assign or transfer these terms to another company without notice.


11) Entire Agreement

These terms, along with the website disclaimer and course-specific terms, form the entire agreement. You acknowledge that you have not relied on any other representations. This clause does not limit liability for fraudulent misrepresentation.


12) Force majeure

We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, terrorism, transport strikes, or legal changes.


13) Assignment

We may assign or subcontract our rights or obligations under these terms to a third party at our discretion. This clause defines the framework for agreement termination and sets out the rights and obligations of each party.


14) Data Protection

We collect and use personal information (“data”) as necessary to provide services. By purchasing services, you consent to this use. We collect contact and demographic data upon registration, use it for communication and course delivery, and may compile user profiles or send messages. We do not share personal data with external parties. Aggregate data may be collected to monitor service quality (e.g., browser, IP, referral URLs). We use cookies and session data to identify users and enhance service delivery. We are not responsible for third-party websites linked from our services. We take reasonable steps (including encryption) to protect your data but cannot guarantee full security. You accept the inherent risks of online communication. We may supplement your data with information from exam boards or employers.

15) Governing Law and Jurisdiction

These terms are governed by English law. Both parties submit to the exclusive jurisdiction of the English courts for any disputes arising from this agreement.
